Diane,

TUPE is where you take over a contract and there are already staff employed by the company direct or by another contractor.

You as the contractor MUST take on the existing employees with their original terms and conditions and pay.

This protects them from losing their jobs and rightly so. It is a mine feild if you want to change anything like Hours etc at a later date.

If you are entering a contract where TUPE applies then make sure you understand fully what is involved. A mistake could cost you your livelyhood.

Get professional help and advice. I am happy to give you guidence on it, but must stress that professional advice is a MUST.
