Opposition At Malls
« on: May 13, 2005, 12:17:13 am »
Has anyone else dealt with this?

About 80% of my work is in malls.  I have been approached by "facility directors" with their entourage (security personel) at 3 out of the 8 malls I clean at.

They insist that I do not clean exterior glass of store fronts after 10AM (Time stores open for business).  They all claim it is for insurance reasons.  However, there are other contractors there with ladders or other equipment.  Also, the malls own janitorial staff are spreading water all over the place.

I have recently challenged one hot-head who told me to take my leave.  He was very rude.  I told him I wanted to see in writing this rule that says I can't clean the ext. glass after 10.  He lied and said it is.  Three store managers looked it up in their merchant's manual and could not find the rule.  Rather, all they found was a rule for merchants to have their glass clean at all times.  So, I laid low for 15 minutes, then went on cleaning for the next 2 hours without seeing him again.

All the managers at the mall say that I do not work for the mall, and the facility director cannot legally make me leave or stop working.

Anyone else deal with something like this?

I would guess technically the manager has the right to refuse entry to whom he likes to the mall.

Why not try to butter him up by being as nice as possible- who knows if you are really nice he may give you the chance to tender for all the malls work.

Mind you he might be after a cut of the contract from you!

Put in a risk assessment, make sure you have got a sign which people will probably trip over. Do everything you can to cover yourself and hand it in to him.

We do a few jobs in 2 shopping malls and to start with at one of them we had a few sort of run ins with some paper pushing jobs worth who quoted this and that.

After nearly blowing a gasket at this jerk I made an appointment to see the mananger of the company who runs the mall and sorted out what was the problem.

In the end all that was needed to make everyone happy was that we use half a dozen small hazard cones.

When we got another 2 jobs in a different shopping mall I went and found the manager in charge and asked if there were any working restrictions. All he said was not on a Saturday, not after 4pm and preferably in the morning. It wasn't a written rule but a request based on common sense.

We didn't do that but it's sound advice. Any more jobs we get I will be doing a risk assessment.
