Why can't you put the holiday pay on top of hourly rate then when they go on holiday or even leave you owe them nowt
There is some contradiction around "rolled up holiday pay"
1) Following a European Court of Justice (ECJ) judgment on 16 March 2006 and more recent judgments in UK courts, Rolled-Up Holiday Pay (RHP) is considered unlawful and payment for statutory annual leave should be made at the time when leave is taken - berr.gov.uk
2)Rolled up holiday pay may be against the law unless your holiday pay is paid on top of your basic pay and it's clear what the amount of rolled up holiday pay is - adviceguide.org.uk
Personally, I'd rather pay them what they've accrued when they take time off rather than pay them it inclusive and run the risk of a tribunal.
I've sent spreadsheet to those requesting it.
