« on: July 31, 2007, 09:26:22 pm »
I saw another window cleaner smoking while cleaning a customers house the other day, apart from this being totaly unprofessional and rude is it legal with the new laws?

I did if I knew they weren't in, or if they smoked themselves.

You can smoke while cleaning a customers windows outside but you can't smoke in the van OR any other vehicle that is used for work EVEN when you are not using for work and EVEN when you are on your own.

So now you know there is no excuse. Mind you it will be like mobile phones........

if you own it and drive it and no other employee or customer uses it either as a passenger or a driver, and they will never use it,  then you can smoke.

However trying to explain that to some copper might not be worth the bother so don't blow the smoke in their faces.  The fine is £1500 if you take a chance and lose.

You cannot plough a field by turning it over in your mind.

shall will clear this one up?????

i am the only smoker at my fire station so i looked into this alot so i could shut the other  up when they had a go at me.

you can smoke at your place of work but only in a designated area designed for smoking, if it has 3 walls and a opening you still cant smoke there. it must be totally in the open, and atleast 2mtrs away from the door or opening, so i just off down to the bottom of the drill yard and puff away to my hearts content,

i smoke at customers houses because i am out in the open, my motto is if they dont like it they can go get another window cleaner, i wont have customers dictating my life, bad enough the goverment do, bunch of

as for vans, if you own it and no one else drives it , you can do what you want in it, ie smoke, but not use your mobile phone,

i have been to the NHS quit smoking clinic and it didnt work,
one day i will give up, most probably when i go in a wooden box ....lol

hope this sorts this one out
regards
Haydn

On Radio WM the other week a council guy came on and said that you cannot smoke in a vechicle you own, if you use that vechicle for work and you claim tax for it.

As for smoking at someones home, dosen't the f*g get all wet and soggy. ;D

To find out for sure, contact your local council and ask them.

You can locate them in the phone book, just under the Gestapo Listing.

Where a vehicle is used for work by more than one person, regardless of whether they are in the vehicle at the same time, it will be required to be smokefree at all times. This protects all who use the vehicle from harmful secondhand smoke, regardless of when they use the vehicle.

Smoking will be permitted in vehicles that are for the sole use of the driver and are not used as a workplace by anyone else, either as a driver or passenger.
