Employee injury

If an employee injures themself at work does your employee liability insurance cover this if they were to sue you?

Just a question, not happening to me.

Thanks

I think it should. I believe of you have an employee it is a legal requirement to have insurance that covers injury in the line of their work.
It's a game of three halves!

It should do a long as he and his employer are complying with H&S rules! If you send him up a ladder and he isn't trained or it's not suitable for the work etc then you might be liable!

Does that mean sending him on some kind of 'training' course rather than just showing him yourself?

Not sure but you need to be able to prove he has necessary skills to use the ladder in the event of an injury. I'm not sure about ladder inspections - frequency or requirements. It's a bit of a nightmare when looking at H&S and employees. Might be worth speaking to an expert so you then know you are legally doing the right thing.

No need for sending him on a training course, he'd have to have been shown how to safley use them though, and he'd have to have a record saying hes been shown signed by the employee to say that he'd been shown how to use them.

I hope he has records of checks of the ladders to make sure there still safe etc.

Lets be honest, he's phucked, as he's not going to have all of that.

My mate runs his own window cleaning company, employing 3 guys. One is his mate and he fell off a ladder with no one at the bottom holding it. His wife told my mate we have 3 years to sue you so he had to keep him sweet and pay him when he was off work. In the end you have 3 years to take your company (employer) to court after that you are time barred.

The insurance pays out, not the company. The big window cleaning company whos near me has had some accidents over the years, 3 people I know have had substantial amounts, one was of work for over a year though, the owner wasn't worried about any claims going in as its his insurance that pays it anyway. All went back to work when fit again too.
