business {name}

can any_one give me any imformation about choosing or registering a business name so far ive been trading under[total clean] as i have recently started working for my self,i was unawere that choosing a name would be so difficult there is already a company trading under this name how will this affect me just payed out alot of money in business cards and sign writen van,how do i stand?
any advice will be most appreciated thanks.

If you wanted to register as a limited company though there is already a Total Clean Ltd... So you would have to register as Total Clean (UK) Ltd or something similar.

But, if your trading as a sole trader etc... you can trade aunder any name you like, even if there is other companies around using the same name.

thanks andy will be trading as a sole trader so total clean name will be ok but what about web site by that i mean domain name can i still use this name or will i have to add somthing to it and is this leagal
sorry for sounding like a novice but thats beacuse i am lol.appreciate all the help ive received from this forum thanks

I have never heared of anyone being Prosecuted  for using a company name under a sole trader, even the banks open business accounts for us under your business names, but add trading as,

but in reality, you are only allowed to trade useing your own name as a sole trader, ie  A.Smith, window cleaners, or A.Smith & son's window cleaners. etc. but like I have said I have not heared of anyone being prosecuted for it, and hundreds of us do it.

Like I said I don't think you will have any problems, I was on another forum yesterday, and there was a company with the same name and almost the same email address. but it was in the states.
But I have a company called reflections in the same town as me, but they sell bathrooms, so there's no conflict between us.

jeff, got a good idea for you, get reflections put on the front of your van, but must be in reverse, so when looking in your rear view mirror they see your name the correct way round, lol

If the domain name you want is available it's yours as soon as you register it. You can check whether a domain name is available at http://www.nameroute.co.uk/cgi-bin/multidomain.cgi

just as a word of note:

if total clean ltd also does window cleaning they can request you cease using the name as they are the owners of the trading name prior to you and therefore you are trading under their name illigally.

i had this issue once in another business of mine - where someone traded under my limited company name as a sole trader - i sent them a letter and they changed names. however my solicitor did suggest sueing them if the letter didnt work!

obviously there are technicalities - but dont fall faul

also if you did set up total clean (uk) limited and total clean ltd complained above you - it is possible companies house would close down your new limioted co (i think this can occur within 6 months of starting a new limited co)
