For those who have franchised their business...

Have you ever been screwed over by a franchisee? I mean have they ever decided to stop paying you royalties and you have had to take them to court etc?

Not a direct answer but....

Yes it does happen and sometimes the franchisee is pursued.

As a Franchisor (same applies to employers, contractors etc) you have a few options, two legal ones are...

Seek an injunction in accordance with your contract which should contain a "fair" non competing clause restricting the franchisee from operating for a set period with a set geographical area

Seek damages for loss of earnings

There is obviously an element of time and cost involved in taking either action whether it is worthwhile remains a personal decision.

In order to expand you would need to choose a course of action be it franchising, employment or contracting, regardless of the chosen route you will be faced with the same dilemma, I am not aware of any system that is full proof, you need to make your decision and hang on for a bumpy ride!

I guess most people will have had similar experiences, although nothing to do with franchising, when it comes to buying and selling work.

On the occasions Ive sold work theres been an agreement that I don't go back and work for the clients that were sold for a set period. The last time I sold work, about a month ago, I put a few words on paper to indicate this so the buyer was at least some way reassured his investment wasn't going to be going walkies by the customers jumping ship and coming back to their previous cleaner.

So far as Im concerned it was only does to reassure him. I wouldn't dream of retaking their work back, I cant be living that way of life these days. There're far easier ways to make a living than ripping people off.

Whether the paper-work would stand up in court is debatable I guess, but it wont get tested anyway.

No, but only a year into franchising so far.

One is an ex employee of 7+ years and good friend, the other 2 are Dads from my sons school.

All seems to be going well so far. In a year the 2 who started on Feb 9th 2015 have grown by at least 50% each and the other started in August 2015 has grown around 25%.

Will be looking to take on my 4th and 5th this year.

Can i ask why did they become/or what could you offer a franchisee in the window cleaning game like what is your USP to get them?

Im just curious as its something i never would of considered before i started
