Ticketed whilst doing a job!
« on: September 11, 2014, 12:05:04 am »
Thought I would share this with you.
Yesterday, I turned up at a customers house and straight away I thought here we go...permit holders only.
I asked the customer do you have a visitors permit I could use  as the traffic wardens are sh#t hot round here?

Thing is she had just moved in the day before and her permits hadn't arrived. Thought I'd chance it, and left a note on my dash stating where I was...not that you could miss me, my machine was running outside 6 feet from my truck.

Anyway, finishing the job off and there's a traffic warden issuing me a £70 ticket! Words were exchanged but he didn't want to know. I told him she resides here but her permits hadnt arrived as she's just moved in...he just smirked...you can appeal!
I did appeal...and lost  :(
Don't know whether to take it further or just pay up. To make things worse the customers permits turned up today.

Wish I'd just threw the whole bucket of dirty water over his head now just to wipe that smirk of his face!

srs? Getting a ticket is quite a normal thing brah. I get at least 2 a year min. Welcome to the real world Terry son  ;D

George Street in Edinburgh is known for having the highest amount of fines in the UK. I think that one street alone generates over £2,000,000 a year on £30 fines.

The good news is Alex Salmond has said if you vote YES there will be no more parking tickets and diesel will be free, just vote YES!
It's not expensive, you just can't afford it.

You appealed on what grounds ?

We work around Central London funnily enough around Westminster and tickets are a daily hazard and here it's very expensive.

I have lost count the number if times I have appealed a PCN and won, I win nearly everyone, so I am surprised you accepted the decision so fast by email, I have never come across that before on the same day.

Maybe due to where we are( I suppose )it takes at least 28 days to hear back in the first instance and then we go from there.

Hilton,

On what basis do you appeal and win each one ?

Agree with Hilton. To have a decision by return just isn't on.  Any appeal has to go to an adjudicator who has to look at both parties pleas. A decision within 14 days is about the quickest I've ever had
I get away with ca 50% of my tickets in London but either way it is a potential expense which I factor into my sales prices just like the congestion charge

Each council is different.

Good luck getting an appeal in Edinburgh. I try every one and only once got let off.

I got this off Kev Loomes, I think it originated from Nigel at Design Care in London.

                 TRAFFIC WARDEN!!
_____________________________________________

This vehicle has a category of "vehicle"/ "van".

We must abide by the highway code to the letter (please note "to the letter")

This machine is classed as "equipment" & as such is not classified separately with the DVLA. For a mounted machine this means that the equipment is bolted down or run from the "vehicle".

However, when we turn this VAN ENGINE OFF, hook up our "equipment" & run from the "vehicle" this "vehicle" stops being classed as a "vehicle" & instead is classed as "EQUIPMENT" & so long as we are not causing an obstruction or dangerously parked then we may run the "equipment" when on double yellows, parking controlled zones etc.

Also, please note the Highway code’s definition of all road markings, sign posts & street furniture. It explains what a double yellow line is & shows a picture. It explains a legal disabled bay, parking zone, speed limit & even states how high a parking zone notice must be.

So if what you see does not keep in line with the Highway code’s definition, it is NOT VALID so if you issue a ticket, IT IS NOT ENFORCABLE.

stuck it in my windscreen, and never had a ticket ;D

Practically every one,

I find something where they did not follow the correct procedure because they expect you to be a complete twat and just pay up with out question...
Nearly always with out exception it's the time difference between when they noted the vehicle and when the ticket was issued, for example on the PCN it will show vehicle time noted by warden 11:03 ticket issued 11:06 and it will say something like ' no unloading was witnessed'

This is a winner every time as they have to allow 'reasonable' time usually 10 minutes to unload etc but because wardens are after as many tickets as they can get to reach their targets they will rush on to the next one and hope you have not noted the time..and I would guess over 90% Don't..

Terry, I did successfully appeal a ticket before.

I was parked in a loading bay too long (whilst I cleaned a sofa in a shop in the centre of Bath)

I appealed on the grounds I was loading to the shop which genuinely was a long way from the loading bay, thus I was gone longer than the 10 mins allowed (or was it 20 mins) either way I got off.

Similar to CraigP

I was unloading  on double yellows at a block of flats where there had been a flood on the 23rd floor, cascading down to the 19th floor. This had knocked out the lift.

My appeal was that as I was unloading it took rather a long time to walk up the stairs to the 23rd floor!!!!!!

In order for my appeal to be successful they asked for an independent letter from the property management company for the block of flats to confirm they had contracted me to deal with the flood.

This was duly provided and my appeal was successful.

Mind you the appeal is still a lot of hassle and waste of time compared to the fine. (But not as much time wasted as walking up 23 flights of stairs!!!!!! Luckily the lift was repaired by the time I was ready to take the next load of gear up.)

I've got a feeling they keep record of your name/reg and will "maybe" be lenient with you first time you appeal then its down hill from there.

I got off first time I appealed but the just laugh at me now  >:(

Maybe some councils are more lenient than others.
