Can anyone tell me what needs to be done if you go down this route. I know in scotland our licence has to change. Also your PLI etc must change but i am more concerned with   how you pay etc n rules / regs....

Same as if you were a limited company

You pay their wages, take off tax and NI, pay tax man plus your contributions
Sort out holiday entitlement, sick pay, employment contract, plus anything else I have forgotten...

You will need to read the HMRC guidelines on that, but if it's part time and ad hoc ie no set hours or days then yes pay as a subby get a receipt - if they fail to declare that's their problem not yours

As Smudger says, but I'd insist on him giving me a proper invoice detailing work done, fees charged etc.  If he's sub-contracting from you he should be able to provide a bona fide invoice with his name, address etc.

So what happens if you pay someone cash and they tell you are self employed and not?

What's the best way to avoid being stung?

Get an invoice from them to state they have been paid wages?

On bigger jobs in the past we have done that.

But was thinking of helping a mate who is desperate for work.

He is self employed. So should I still ask for an invoice per day?

Yeah, an invoice from him will be good.
Tell him you need it so you don't pay tax on money you've paid out.
Mate did a but for me, not aggy but he looked a little like I didn't trust him. So I just said above.

I used to sub-contract for someone years ago in another trade.
I was told to invoice him after every week I worked for him detailing my hours as that was the instruction from his accountant.

On jobs we get invoices. But one person could be there all day.

But this is more adhoc so do not want to get stung.

Thanks.

Anybody that gives you an invoice for work, make sure it has their UTR number on it. No problems that way  ;)
