 I have got a guy working for me on a self employed basis but I have been told that he should be employed because he is using my Equipment ie van, poles, filters, water ETC .

Does anyone know the answer?

I started out this way.
To get round it, my boss told me what the crack was and encouraged me to get some work of my own.
He didn't charge me for anything, only paid for my own diesel whether doing his work or mine.
We did this for 2 years without any problems at all.
I'm not saying that you should do this but his accountant said it was fine back then.
I'd be interested if you find out for definite.
Perhaps your accountant could shed some light?

can also depend if he works for anyone else, if not then it would be classed as employed]

If a person has a choice whether to do the work or not and can decide when he does it, then he is self employed.

If all the work he does is for you, then he is classed as employed.

If he has no other work that he does and uses your equipment, van, etc, then he is definitely classed as employed by HMRC.

best to employ and dont encourage em to get other work ,you want total loyalty . make sure theyr busy with fresh work coming in often
