Justice at last
« on: May 14, 2013, 06:13:00 am »
Finally I can see an end to what has been a very costly and annoying period.
In July last year one of my vans was written off in an accident, (no fault of ours it was parked at the time)
The insurance were very good, they gave me a hire van for a while then paid out what I felt was a decent amount for an old van. The problem I had was I was not expecting it so never had a lot of funds available to add to it so ended up having to buy cheap.
I searched everywhere and eventually bought a Renault Traffic from a dealer up near Wigan.
It did 300 miles before going bang!!
I contacted the dealer who said “ get it diagnosed and let me know what the situation is, it makes more sense to fix it at your location due to the distance”
But as soon as it became apparent the bill was going to be very large he changed his tune and accused me of “Breaching my warranty by working on the van” and said it was not his problem.
Yesterday I had my day in court and the judge found in my favour so next week the van goes back, I get a full refund plus expenses.
It broke down Sept 6th last year so as you can imagine it’s not been easy.
So what van next (please don’t suggest Renault)   I am leaning toward a Citroen Dispatch as have decided I don’t want one that’s too large but just large enough for 2 people when needed.
I think I may go for contract hire this time as at least with a new one I get a decent warranty.

I've got nearly the same situation with my van, except this has been ongoing since August last year. Costs of court and solicitor so far is over 5K. Expensive here. Should get the result within the next 4 weeks. Sweating.
No still don't understand, I must be thick

Good luck with that. I never used a solicitor as i felt i had a vwry atrong case plus the cost is crazy, so I tried to have  everything laid out in such a way so I could answer any question and have evidence to back it up.
I was told by a friend that the easier you can make it for the judge the better it helps your case. The judge actually commented on the "exemplary"way it was presented.
Even so it's a nerve racking experience and not one I would want to repeat in a hurry.
Let us know how you get on

Really glad you got some justice and glad you had the strength to go to court. Flipping dodgy car salesman not wanting to honour their warranties. But thankfully there are some good ones too.
Well done

Wouldn't stand a chance of doing it yourself here mate!!  ;D Technical German and a civil law book that's got 7 volumes!! I wasn't legally insured to pay for my solicitor, although I'm insured for everything else. I didn't renew my legal insurance so am having to pay everything up front. By the time it's over, with luck I get every penny back. Will let you know  ;)

Renaults are poop, but seen as you liked the traffic why don't you get a vivaro, same van but vauxhall. I had a traffic, it was crap and I've had two vivaros since, great vans.

Great van, I have the long wheel base, great for all the extra equipment we carry.

Wait until you have your money in your hand.
Dodgy car dealers never listen to a judge most think that they are above the law.
You will get it eventually but it might involve the bailiffs.
Hope I am wrong on this one. Best of luck.

Going new? Hyundai iLoad with 5 year warranty. Had mine from new 14 months now. RWD and highest torque in it's class. (2.5diesel)
It's a game of three halves!
