4 months and still waiting !
« on: February 02, 2012, 03:42:05 pm »
Received a phone call 4 months ago to clean some carpets. Two bed flat (repossesion).
I picked the keys up from the letting agent, cleaned the carpets, dropped the keys back off and sent my invoice for £90 to the repossesion / property developers which unfortunately for me are 300 miles away !

Four months on I'm still waiting for payment.
I have lost count of the times I have rang the company and the guy who instructed me to do the job.
Usual excuses...he's out of the office, I'll tell him to ring you back, the cheque will be sent out this weekend etc
I rang the letting agent today and they told me they are powerless to retreive any unpaid monies.
It has also came to light that the people who I have speaking to (and owe me the money) dont actually own the property, they are a contractors employed to get work done.

Dont know what my next course of action should be ?
Is it worth going through small courts for £90 ?
As the property is still up for rent, I'm tempted to view...and dump the crap back on the carpet, but dont want to get into trouble with the law  :'(

You can't beat writing a threatening letter with something outrageous in it like added interest at £6 per day. Tot it up and send them the hugely over-inflated bill.

What have you got to lose.....? ;D

I would accept that you're never going to get paid, so have a bit of fun at their expense, it'll make you feel better.... :)

Terry,

I am reading this as you were instructed by the agency to do the job or by the owners?

Yes, it IS worth chasing £ 90.00. If they have a CCJ, they cannot get credit.

Wouldn't it be terrible if the keys (or a copy) fell into the hands of squatters?

Terry above website tells you everything you need to know, its your right to add penalty notice + interest , all explained above. Send amended Invoice - this has been covered in 'General section' sometime b4 xmas try a search... It can only be applied to a company not individual!

good luck

Terry,
do you have anything in writing at all or can you get it.
If you send a ccj to them and they defend it by telling the court that they did not authorise the work, unless you have anything to the contary you will lose the case. From bitter experience we will not proceed with any work whatsoever until we have something in writing, even it is a quick e mail. It is very rare that we get a problem but we do not price work to allow for non payment.

They're not going to pay by 'natural' means after this time.
If you have anything in writing all the better for a small claims court although you can still get a CCJ against them without this so called proof. I've done it a few times and have yet to lose :)
Personally I would be inclined for the 'get even' stage now. Arrange a viewing but prior to actually seeing the property deposit some 'selective' products near the door so you can rub your boots into before going into the property. They'd struggle to prove intent against you if they wanted to get funny about it, and anyway even if you admitted intent it would be cancelled out by the money you are owed for cleaning up the previous mess.

Neil and Peter, yes I do have proof they asked me to carry out the work...in an e mail from their company.
They even asked me to take before and after pictures to make sure I carried out the work...the cheek of it !!! :o

Sorted then. Google small claims court and you can do it yourself on line for about £30 which gets added to the bill. But firstly threaten them with this action if payment not received within 7 days and do it by registered mail.

I wouldn't mess about now, send them a letter that you Intend to go through small claims, wait 7 days then do it online, costs about £25 and is worth every penny, I've had to do it twice and on both occasions there's been a cheque arrived at the end of the week,

No genuine business is going to risk a ccj, it just it's the frighteners on them and shows you mean business.

Steve

Google Thomas Higgins Solicitors and register with them it will cost about £2.50 for them to send a solictors letter and I am sure you will have a cheque pretty quickly.
In the past we have always got payment ths way but have still been to court on 5 other occasions.
