crb check has come back with history - is this a problem?

just got a standard crb check come back on a staff and it's got 3 issues on it. without going into too much detail one is for theft over 8 years ago when they were a minor but the punishment was only reprimanded.

i've never had to deal with crb checks coming back with anything so don't know what to do now. i'm ok with how it's come back but i wonder if the customers need to know this personal information and if it's something which means i can't take on the staff as they'd be left alone for periods of time, which would suck as this person has worked with me before and is very good.

In a situation like this, You need to use good judgement.

Was the member of staff aware that you have received the CRB Check back with history?

Were you aware about the history prior CRB check? By the sounds of it you were not aware.

You state there are 3 items one being theft when he/she was a minor. This now probably is irrelevant. But not to be forgotten.

Were the other 2 items the same i.e. theft? And were they much recent. You have to weigh it up and see the relevance. For example he / she might have one for criminal damage see how recent it was a ask them about it. It might have been a lovers tiff and he damaged the car or house door in temper.

You also state that this person has worked with you before and is good. So you also have to judge the persons character in the present day.

I have employees that have history. Depending on that history they are only allowed on certain sites "alone" or not at all. (Or worse still not employment with us).

Also when questioned about history you have to be careful and try not to think the worst. They probably will be embarrassed about it and automatically think you will not trust them.

Some people do change, some people do get charged through no fault of their own (This I am aware of) sometimes the law (police do get it wrong).

As for making the client aware, unless its in your contract you do not need to make them aware. (That does depend on circumstances) i.e school cleaning so if its a child molester they need to be banned.

thanks for the reply dave. pretty much answered it all for me. Would like to see others views on this but I from what you've said i'm sure it'll be fine as i have a good relationship with this person already and trust the person they are today.

Just to let you know I currently have the same issue with an employee, you may find that your insurances are invalid if you do not inform the insurance company.

you must never divulge information from a CRB check to anyone without first taking strong advice. It is very rare that it would be necessary to inform anyone as it covered under data protection laws so you could actually land in trouble. Always put a clause in the contract that the job is subject to a suitable CRB check- which then gives you an out should you wish. Furthermore if the incident occurred when they were a minor (under 16) they can apply to have it removed and should succeed.

Further to the last post I should point out that anybody registered to do CRBs should know about them as they are serious bits of information and as an employer your in a very responsible position when dealing with such privileged information. Don't forget that actually the info should be shredded also with only the number and date been recordable..........although unless someone inadvertantly sees them nobody would know.
