Van and me got involved in an accident today! New

UPDATE! been offered £1250 to close the case, do you guys think thats fair?

some chav ploughed into my customers parked car, which ploughed into me and my van! i jumped into my van but my leg got crushed by the car. only bruised and cut though.  i think the custs car took a lot of the impact, and my towbar stopped the car from really damaging me. 1st job of the day too, went home after that. never mind live to see another day.

wow just realised what you were saying you were in between the 2 your lucky mate couldve been alot worse eh

a few months back a friend of mine who works as a builder was doing some work for a mechanic , the mechanic had a body shop and a young apprentice worked for him, one morning, he jumped in a vehicle to start the engine and the kid was at the front of the car, it was in 1st and he didnt realised it leaped forward and pinned the kid to the wall and unfortunately he died the mechanic was pretty distraught obviously.

so you were lucky eh!!

if you was off work for the day or days after you should be able to claim for that or is that already included in monies offered, how bad was van? would the monie s offered pay for van and time off? if so then probably not bad, but always told never to take 1st offer

no permanent bodily damage, the van door doesnt lock at the bottom, but im sure i can fix that eventually. havent lost any work time. that money is just for my cut leg. i could claim for money lost but i think i might be pushing it, the max they pay out for damage that you recover after only a few weeks is £500, so i think ive done alright there.

might put it towards a diy camper or a supermoto?  ;D

the max they pay out for damage that you recover after only a few weeks is £500, so i think ive done alright there.

Never take first offer.

They will add another 500 on that without a second thought .

be careful how they have offered it to you, there is a clause where if they offer you a fair amount and you say no,  and it goes to court and you still win they can make you pay there legal fees, so you could end up with less,   

did you report it to your insurance  what have they said,  u might be better just taking the money and running

Our car got hit from behind by a lorry, my daughter had a stiff neck for 2 days and was offered £1,500.

If the £1250 is an early or first offer and you are in no pain whatsoever after a long enough period then offer to settle for £2500.

If you are in pain or have any doubt whatsoever that this injury will come back and haunt you then see a solicitor.

Have you been to hospital?

yeah this is a claim on the chavs insurance. i was hoping for £1000 so should be happy with it. if i try for more i have to have a medical, and could get less than half the amount, as im totally healed now.

yeah will say yes to it. wife insists i need to spend it on the new camper. will have to wait for a new motorbike.  >:(

No sue the bugger!!! If you had ploughed into said chav then no doubt he would of milked it. I have a solicitor in the family and there is no way they would except that. For a start there is the emotional aspect, then the loss of earnings, the physical damage and the damage to the towbar (OK the towbar took the main impact but what is to say that the impact hasn't caused structral damage to the van?) I have read what you said regarding this but I would try and put the frighteners on to be honest and you will stand a chance of doubling you money in the least. Lay it on as thick as you can (if they want a medical then you choose the doctor who provides it! Personally I would of tried to get the van written off and done em for a new one, loss of earnings the works. Say it was discovered subsequently that the van had in fact suffered stuctural damage then £1250 is not a lot, especially as that system now needs checking as the anchoring system has took a hit ;)  I would refuse the offer, tell them that you want at least 5k as an out of  court settlement and you should end up with a figure around what Gold suggests! Just as advised make sure you read the small print and that they understand this settlement is on your terms not theirs ;)   They might tell you you need a medical but there could be hidden costs to this incident (ie if it turned out the systems anchors had been stressed and it needed refitting. This is not just about personal injuries but also about potential future loss as a result of this. That said if you are happy with the ammount offered and are sure there is going to be no future problems as outlined then the offer isn't the worst I have heard of.

I do agree with WCE and not only that its the mental scars it has on you without you known it and the reoccuring dreams of the incident etc.:)
