Your thoughts please...legal matters

I need to know where i stand legally on this-

I advertised in the local rag for a window cleaner with experience
had a few numptys ring up.

Anyway picked this one lad out that said he had experience, turns out he didnt.
told him to come along Wednesday for a trial. We did about 6 hours work and i paid him £6 p/h

The part time lad that i had with me has now decided to go full time which i accepted

rang the the other lad up and told him that i was very sorry but im sticking with the part timer as he knows the job, got experience etc....

He said that what ive done is illegal and hes going to get a solicitor onto me plus hes going to come round and burn my van out  ;D ;D a right charmer.

What are your thoughts

just ignore him he will go away ;) you gave a trial and he failed simple.

he is just trying it on,  all u got to say was it was a trial and he was crap and you told him it was a trial period,

you gave him a trial and i guess paid him cash?

can you see him letting the tax man know of his days earnings??? - no!

he gave you a false answer when he said he had experience so i would def not worry about a thing!

I took one onboard few months before christmas saying he worked for a company window cleaning for two years... well all i can say is he was rubish most things have to be re cleaned.


i think because they think oh its only window cleaning they can lie on there CV or something and think we wont know  ??? the idiot could'nt even keep a wake for 1 day without sleeping between every job.

In the end he asked to be sacked and asked me to type a letter saying there is no work se he can go on the dole.. BLOODY CHEEK

Best bet is to train them from scratch. I've done this many times over the years and have found that it can take anything up to 12 months before their anywhere near what you'd class as a half decent shiner!  :)

Did you make it clear that it was a work trial?
If so, then you shouldn't have paid him as generally work trials are unpaid.

However, you can get out of this one quite easily.

Make up a matrix, listing different elements of the job, such as level of interpersonal skills, ability to take on new tasks and other things you would want your assistant to be like or skills you would like them to have.
Then score both, on a scale of 1 (low) to 5 (high).

* List the right skills required and you can prove that you "selected" the best candidate.

Used to use this method when making compulsory redundancies. As long as it's clearly documented - you're in the clear !

Send him a letter which states you are taking him to court for claiming he had experience, coupled with the threats which you recorded.

You figure the bullet proof way of victimising employees you don't like so there's no come backs for the company and they repay you by giving you a one on the matrix- thanks for that by the way- and next thing they keep the lap top and you get to carry a  mop and bucket.
