II.1.3) The notice involves: A public contract.
II.1.5) Short description of the contract or purchase(s): Transport for
London’s (TfL) Head Office portfolio is over 50 buildings, located mainly
in Central London, comprising some 2 m sq ft and circa 11 000 occupants
consisting of TfL and its Tenants. It should be noted that TfL’s
Accommodation Strategy will inevitably change both the profile and
occupancy of the Head Office building portfolio during the period of this
contract.
TfL are seeking to place a contract to procure the services of a company
to provide General Facilities services. A brief summary of the requirement
is detailed below:
— Cleaning Services,
— Pest Control,
— Horticulture Maintenance,
— Waste Management – please note that this part of the contract has
already been let to a specialist service provider and will be novated into
the main contract.

Transport for London (TfL) is a complex organisation operating both as an
executive agency of the Greater London Authority (GLA), under the
direction of the Mayor of London and as a provider of Transport services.
The scope of proposed services may encompass activities within the scope
of both Directive SI 2006 5 and Directive SI 2006 6. Services to be
provided in relation to activities which are subject to the Directive SI
2006 6 (Utilities) will not be subject to a separate notice.
The services may be provided to TfL and/or its subsidiaries and may also
encompass London Regional Transport (LRT) and/or the GLA and some or all
of its functional bodies. A contract may be awarded to the successful
contractor by any part of TfL and/or any of its subsidiaries. The Awarding
Authority reserves the right to withdraw from the procurement process
and/or not to award any contract as a result of the competition called for
by this notice. The Awarding Authority shall not be liable for any costs
or expenses incurred by any candidates in considering and/or responding to
the procurement process. All discussions and meetings will be conducted in
English. Tenders and supporting documents must be priced in Pound Sterling
and all payments under the contract will be made in Pound Sterling.
TfL may interview any or all companies who express an interest in
tendering for this work. If and when this requirement is offered to
tender, this may be done in whole or in part via electronic means using
the Internet. It may also be through the medium of an electronic reverse
auction. TfL strongly supports and implements the Greater London Authority
Group Responsible Procurement Policy.

VI.4) PROCEDURES FOR APPEAL
VI.4.1) Body responsible for appeal procedures: Transport for London,

VI.4.2) Lodging of appeals: Precise information on deadline(s) for
lodging appeals: This authority will incorporate a minimum 10 calendar day
standstill period at the point information on the award of the contract is
communicated to tenderers. This period allows unsuccessful tenderers to
seek further debriefing from the contracting authority before the contract
is entered into. Applicants have 2 working days from notification of the
award decision to request additional debriefing and that information has
to be provided a minimum of 3 working days before expiry of the standstill
period. Such additional information should be requested from the address
in section I.1.
If an appeal regarding the award of a contract has not been successfully
resolved, the (for Public Sector) Public Contracts Regulations 2006 (SI
2006 No 5) provide for aggrieved parties who have been harmed or are at
risk of harm by a breach of the rules to take action in the High Court
(England, Wales and Northern Ireland).
Any such action must be brought promptly (generally within 3 months) where
a contract has not been entered into the court may order the setting aside
of the award decision or order the authority to amend any document and may
award damages.
If the contract has been entered into the court may only award damages.
