Terms and Conditions for Letting Agents

Hi Marigold here.
I've been cleaning houses for a while but just had an enquiry from a letting agent.  I've taken on three self employed cleaners, but I'm worried about the Terms and Conditions I should get the letting agent to sign.  Does it have to be complicated? Can I write it myself?  should I get a solicitor to look at it? (£100 per hour plus VAT apparantly.)  Any help would be so appreciated.

let me know your email and I will email you a copy of my terms that I use for letting agents.

be careful though they change cleaning companies all the time and sometimes just to delay making a payment!

On another note: I was looking at taking on self employed to avoid high employment costs, how do you do it pay them etc, how can you avoid them starting on their own and stealing your clients?

Hi Carl,
I've sent you an email outlining how I try to prevent this happening although it's probably impossible to stop altogether.  You just have to let your staff know when you take them on what the implications are.  The client needs to know as well.

hi just wanted to enquire how are you getting away with your cleaners being self employed i have spent the last few weeks with my accountant and the inland revenue support team and they say that staff cannot be self employed.

I think the operative word is staff..............remove it and you are sub contracting the work, which is perfectly normal practice.

thanks for your reply but would they not have to invoice me, and according to the inland revenue if they earn over £82 per week you have to register as their employer. and deduct tax and ni as appicable.
bearing in mind the nature of our business the cleaners may be reluctant to sign a p46. if they did you could keep their wages under the threshold for tax. it is so frustrating i am getting the work coming in but i just cant get my head around this side of it. also if they invoice me then they need to be registered self employed in their own right.

as far as i am aware if the self employed person gets work from various places, they could just invoice you, but like you say if they just do work for you then you would be classed as employer,
ask local tax office they dont bite, quite helpfull.
