VI.3) Additional information
The contracting authority considers that this contract may be suitable for
economic operators that are small or medium enterprises (SMEs). However,
any selection of tenderers will be based solely on the criteria set out
for the procurement, and the contract will be awarded on the basis of the
most economically advantageous tender.
Hertford Regional College have a requirement for a building cleaning
contract to cover daily cleaning and periodic cleaning provisions.
Hertford Regional College is split over 4 sites. There are 2 main campuses
one in Turnford and one in Ware, both of which sites have recently been
updated with state of the art buildings and the latest technology. The
college also has 2 satellite offices one in Waltham Cross and the other in
Bishops Stortford, in addition to this the Turnford Campus also has a
Children’s Centre which needs to be priced separately.
The college requires a contractor with educational experience and the on
site cleaning staff will need to be CRB checked.
Apart from full time students they have nearly 400 apprentices, 500
college pupils aged 14-16 on part-time vocational courses, and over 1 000
on train to gain programmes for people in employment. Some 1 600 adults
are enrolled on adult and community learning courses which are delivered
on behalf of Hertfordshire County Council and around 400 higher education
students are on foundation degree and other courses run in partnership
with Hertfordshire University and the University of Greenwich.
The contract period is for 5 years commencing on 1.8.2012, it may be
extended year on year for a further period of up to 2 years at the
colleges discretion. The annual value of this contract is approximately
325 000 GBP (excl VAT).
Hertfordshire Business Services is the trading arm of Hertfordshire County
Council and are tendering the cleaning services for daily and periodic
cleaning on behalf of Hertford Regional College. All queries regarding
this tender should be directed to Hertfordshire County Council via the
Delta email system rather than the College.
The Council reserves the right at any time to cease the tendering process
and not award a contract or to award only part of the opportunity
described in this notice. If the Council takes up this right then they
will not be responsible for, or pay the expenses or losses, which may be
incurred by any tenderer as a result.
The Council undertakes to hold confidential any information provided in
the proposal submitted, subject to the Council's obligations under the
law, including the Freedom of Information Act 2000. If the applicant
considers that any of the information submitted in the proposal should not
be disclosed because of its sensitivity then this should be stated with
the reason for considering it sensitive. The Council will then endeavour
to consult with the applicant about such sensitive information when
considering any request received under the Freedom of Information Act 2000
before replying to such a request.
Due to the current economic climate, Hertfordshire County Council reserves
the right to carry out additional financial checks on all companies
tendering for this Contract at any time during the procurement process, to
ensure that they continue to meet the Council's requirements and remain
financially viable to perform the contract.

Precise information on deadline(s) for lodging appeals: Hertfordshire
County Council will incorporate a minimum 10 calendar day standstill
period at the point information on the award of the contract is
communicated to tenderers.
If a complaint between the Council and the tenderer regarding the award of
a contract has not been successfully resolved the Public Contracts
Regulations 2006 (SI 2006 No 5) provide for aggrieved parties who have
been harmed or are at risk of harm by a breach of the rules to take action
in the High Court (England, Wales and Northern Ireland). Any such action
must be brought promptly (generally within 3 months). Where a contract has
not been entered into the Court may order the setting aside of the award
decision or order the authority to amend any document and may award
damages. If the contract has been entered into the Court may award damages
or declare the contract ineffective. Tenderers are advised to seek
independent legal advice in relation to remedies they can pursue under the
Public Contracts Regulations 2006 (SI 2006 No 5).
